Terms of Service

Article 1 — Purpose and Definitions

These Terms of Service (hereinafter "Terms") govern the contractual relationship between BizzKeys SRL (hereinafter "Azuvida", "we" or "the Publisher") and any natural person using the Azuvida mobile application and/or the website azuvida.com (hereinafter "the Service").

BizzKeys SRL — a private limited company under Belgian law, company number (CBE) BE 0465.536.058, with its registered office at 14 Rue de Loyers, 5340 Gesves, Belgium.

In these Terms:

• "User" means any natural person accessing the Service who has created an account.
• "Patient" means the User who configures their own tracking tasks.
• "Caregiver" means the User designated by a Patient to receive alerts.
• "Professional" means the User holding a Pro subscription and managing the tasks of multiple Patients.
• "Content" means any data entered by the User into the Service (tasks, validation photos, etc.).

Article 2 — Service Description

Azuvida is a mobile application (iOS and Android) designed to assist with the tracking of critical tasks — in particular the regular intake of medications or treatments. It enables the User to:

• Plan and confirm recurring or one-off tasks.
• Receive reminders and push notifications at the scheduled time.
• Designate caregivers who receive an escalated alert (push, email) if a task has not been validated within the allotted time.
• For Professionals: supervise the tasks of multiple Patients from a dedicated dashboard.

The Service is available in three plans:

Access to certain features is subject to taking out a paid subscription. The Publisher reserves the right to modify the features included in each plan with reasonable notice.

Article 4 — Acceptance of Terms

Use of the Service constitutes full and unconditional acceptance of these Terms. By creating an Azuvida account, the User acknowledges having read and accepted these Terms without reservation.

The Terms in force are those accessible at azuvida.com/en/terms.html at the time of use of the Service.

Users must be at least 16 years of age to create an account. Use by persons under 16 is not permitted without the consent of a person holding parental authority.

Article 5 — Registration and User Account

Creating an account is necessary to access the Service. Users may register using:

• an email address and password;
• a Google account (via Google Sign-In).

Email registration requires verification of the email address. Until verification is completed, access to features is limited.

The User undertakes to provide accurate information at registration and to keep it up to date. The User is responsible for the confidentiality of their credentials and for all actions carried out from their account.

Only one account per person is permitted. Creating multiple accounts or using a fictitious account is prohibited.

Article 6 — Subscriptions and Payment

Paid subscriptions (Sérénité and Pro) are offered with a 30-day free trial period, with no credit card required at the outset. At the end of the trial period, payment is charged automatically unless cancelled beforehand.

Billing is managed by the distribution platforms:

• Android: Google Play, in accordance with the Google Play Terms of Service.
• iOS: Apple App Store, in accordance with the App Store Terms and Conditions.

Prices are inclusive of all taxes (VAT managed by Google / Apple as the merchant of record). The Publisher reserves the right to change prices with at least 30 days' notice by in-app notification.

Renewal: subscriptions renew automatically at the end of each period, unless cancelled at least 24 hours before the renewal date.

Cancellation: cancellation is carried out directly from the Google Play or App Store settings. Access to paid features remains active until the end of the current period.

Refunds: refund requests are subject to the respective policies of Google Play and Apple. The Publisher does not intervene in transactions carried out via the distribution platforms.

Article 7 — Right of Withdrawal

In accordance with the Belgian Code of Economic Law (Book VI) and Directive 2011/83/EU on consumer rights, the User has a 14-day right of withdrawal from the date of taking out a paid subscription.

However, by beginning to use the paid features before the expiry of this period, the User expressly acknowledges that performance of the contract has begun with their agreement and waives their right of withdrawal in respect of the part of the service already performed.

For purchases made via Google Play or the App Store, the right of withdrawal is governed by the policies of those platforms, which act as the merchant of record.

Article 8 — Personal Data

BizzKeys SRL is the data controller for personal data collected in connection with the Service, in accordance with Regulation (EU) 2016/679 (GDPR) and the Belgian Law of 30 July 2018.

Data collected includes, in particular: email address, account data, configured tasks and schedules, validation timestamps, validation photos (automatically deleted after 7 days), and subscription data.

Health data (medication tasks) constitutes sensitive data within the meaning of Article 9 of the GDPR and is processed on the basis of the User's explicit consent.

In the event of a dispute relating to data protection, you may contact the Data Protection Authority (DPA) — www.autoriteprotectiondonnees.be — or, for French residents, the CNIL — www.cnil.fr.

Article 9 — Intellectual Property

The Azuvida application, its source code, design, texts, graphics, logos and all its components are the exclusive property of BizzKeys SRL and are protected under Belgian and international intellectual property laws.

The Publisher grants the User a personal, non-exclusive, non-transferable right of use, limited to the scope of the Service, for the duration of their subscription or free account.

It is strictly prohibited to reproduce, modify, distribute, sell or commercially exploit all or part of the Service without the prior written authorisation of BizzKeys SRL.

Article 10 — Liability

The Publisher undertakes to provide the Service with the care reasonably expected of a professional service provider. However, its liability is limited in the following cases:

• Temporary interruptions to the Service due to maintenance, technical failures or external causes (hosting provider, network, etc.).
• Loss of data attributable to force majeure or to the fault of the User.
• Indirect damages, loss of profits or data resulting from the use or inability to use the Service.
• Medical or health decisions taken on the basis of information displayed in the application (see Article 3).

In any event, the contractual liability of the Publisher towards a User shall not exceed the total amount of subscriptions paid by that User during the preceding 12 months.

The User is solely responsible for the information they enter into the application and for their use of the Service.

Article 11 — Termination

By the User: the User may delete their account at any time from the Profile section of the application. Deletion results in the immediate deactivation of the account and deletion of personal data in accordance with the Privacy Policy.

Cancellation of a paid subscription does not result in deletion of the account but only in the cessation of automatic renewal at the end of the current period.

By the Publisher: BizzKeys SRL reserves the right to suspend or delete an account in the event of a breach of these Terms, fraudulent behaviour or abusive use of the Service, with prior notification except in cases of urgency.

Article 12 — Changes to Terms

The Publisher reserves the right to amend these Terms at any time. Users will be notified of material changes by in-app notification and/or by email, with at least 30 days' notice.

Continued use of the Service after the amended Terms take effect constitutes acceptance of those Terms. If you disagree, you have the right to delete your account before the effective date.

Article 13 — Governing Law and Jurisdiction

These Terms are governed by Belgian law. In the event of a dispute between the Publisher and a consumer User, the parties undertake to seek an amicable resolution within 30 days before resorting to legal proceedings.

Failing an amicable agreement, disputes fall under the exclusive jurisdiction of the courts of the judicial district of Namur (Belgium), without prejudice to the mandatory consumer protection rules applicable in the User's country of residence.

Consumers may also use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
